Real Estate Cold Calling Scripts and the Do Not Call Rules

Real estate cold calling scripts only work if you are allowed to make the call in the first place. Before the script comes the list, and before the list comes the National Do Not Call Registry, your own do-not-call list and your relationship with the person. This guide covers the rules first, then gives real estate cold calling scripts for three situations, replies to common objections and a routine for logging every call.

Can Real Estate Agents Cold Call Homeowners?

Sometimes, but a registered number is off limits unless an exemption applies. The FTC’s Do Not Call Q&A for telemarketers says sellers must synchronize their lists with the registry at least every 31 days. It also says a company can call a registered consumer for up to 18 months after the person’s last purchase or transaction, and for three months after an inquiry. The same page says the person can still ask you not to call again, and that fines can reach $53,088 per violation.

The FTC’s guide to the Telemarketing Sales Rule adds that outbound sales calls may not be made before 8 a.m. or after 9 p.m., that the seller’s identity must be disclosed promptly, and that callers must transmit caller ID information. State rules can be stricter, so ask your broker before you build a call list.

Real estate has its own wrinkles. North Carolina Realtors’ summary of the Do Not Call rules explains that the FCC declined to carve out expired listings, and that calls to for-sale-by-owner sellers are not solicitations only when a real estate professional is calling for a buyer they represent. Calls that offer your services to homeowners are still covered. This is general information, not legal advice.

Situation Can You Call?
Number is on the registry and you have no relationship Not to solicit, unless another exemption applies
Past client, within 18 months of the transaction Generally yes, unless they asked you to stop
Someone who inquired within the last three months Generally yes, unless they asked you to stop
Expired listing owner on the registry Not without an exemption
FSBO seller on the registry, to offer your services Not without an exemption
Number not on the registry or your own list Yes, within calling hours and state rules

If you use autodialers, texts or prerecorded messages, consent rules apply on top of this. Our guide to TCPA compliance for real estate agents explains what is enforceable today.

How Do You Structure Real Estate Cold Calling Scripts?

Good real estate cold calling scripts are short and built around permission. Guides from brokerages and vendors tend to agree on the order: say who you are, give a real reason for calling, ask whether it is a good time, ask a question, and finish with one next step. The wording below is our suggestion. Use your own words and keep each call under a few minutes.

  1. Identify yourself. Name, brokerage and the reason in one sentence.
  2. Ask permission. “Do you have a minute?” If the answer is no, thank them and end the call.
  3. Ask one question. Make it about their plans, not their identity.
  4. Offer something useful. A market update, a value estimate or an answer.
  5. Ask for one next step. A short meeting, an email address or a follow-up date.

Real Estate Cold Calling Scripts for Three Situations

These scripts assume you have checked the registry and your own list and that you are calling someone you may call. Replace the items in brackets.

Past client check-in

“Hi [Name], this is [Your name] at [Brokerage]. We worked together on your home in [year]. Do you have a minute? I am calling a few past clients to share what homes on [street or area] are selling for, and to ask if you have any questions about your home. Would a short update by email be useful?”

Inquiry follow-up

“Hi [Name], this is [Your name] at [Brokerage]. You asked about [address or topic] on our site, and I wanted to follow up. Do you have a minute? What are you hoping to do and by when? I can send you [the listing details, a value estimate] today.”

Neighbor just sold

“Hi [Name], this is [Your name] at [Brokerage]. A home on [street] recently sold, and I am speaking with neighbors who may be curious about values. Is this a good time? If you have ever wondered what your home is worth, I can send a free estimate. What is the best email for it?”

Use the third of these real estate cold calling scripts only for numbers you have checked. If you cannot call, send a letter instead, as covered in our guide to real estate prospecting letters.

How Do You Handle Objections in Real Estate Cold Calling Scripts?

Treat the first objection as information, not as a wall, and accept a clear no. These replies are our suggestions:

  • “I am not interested.” “Understood, thanks for your time. If that changes, you are welcome to call me.”
  • “I already have an agent.” “That is great. If you ever want a second opinion, I am here.” Then respect it, because NAR’s Code of Ethics bars practices inconsistent with another REALTOR®’s exclusive agreement.
  • “Send me something.” “Happy to. What is the best email?”
  • “How did you get my number?” Answer honestly. If they ask you not to call again, apologize, end the call and add the number to your own do-not-call list that day.

How Do You Log and Follow Up on Cold Calls?

Write down every call: the date, the number, the outcome and the next step. A request not to call goes into your do-not-call list immediately, because the FTC says companies must honor it. Keep that list with the registry check date so you can show what you did if a complaint arrives.

Move interested people into a follow-up sequence with a date for the next touch. Our guide to CRM marketing for real estate covers the setup, and our guide to real estate agent referrals shows how to ask good contacts for introductions. Infina AI, our own product, is an AI assistant for real estate agents that helps with follow-up and listing questions, so a person who says yes on a call hears from you again the same day.

Real estate cold calling scripts serve one channel among several. Put them next to door knocking for real estate agents, mail and referrals in your real estate marketing plan, and track which one brings appointments for the time you spend.

Common Real Estate Cold Calling Mistakes

  • Skipping the registry check. It is the quickest way to a complaint.
  • Calling at the wrong hours. Stay inside the 8 a.m. to 9 p.m. window of the person you call.
  • Reading a script word for word. Use bullet points and your own voice.
  • Pushing past a no. End the call politely and record it.
  • Using prerecorded messages without consent. Check the TCPA rules first.
  • Not logging calls. Without records you cannot prove compliance or find what works.

Final Thoughts

Strong real estate cold calling scripts start with a clean list. Check the registry and your own do-not-call list, call within the allowed hours, ask permission, make one useful offer and one ask, and log every outcome. When a number is off limits, use mail, referrals or a visit instead, and keep your calls for the people you may contact.
